1.0 DEFINITIONS

In this document, the following terms shall have the following meanings:

1.1 Accredited Course Provider(ACP) means the college/teaching institution or any other entity that you have chosen and thatis accredited or otherwise approved by the appropriate accreditation authority to organize and offer you teaching forrequired courses orto provide assessmentfacilities.

1.2 NEBOSH stands forthe National Examination Board in Occupational Safety and Health. It is a UK-basedexamination boardthat provides a range of globally recognised qualifications in health, safety, and environmental management.

1.3 Application Form means the form submittedby you to Green World Group (GWG) when you apply to enrol orregister for a qualification with GWG.

1.4 Conditions mean these GWG General Conditions for Students or any applicable ACP.

1.5 LMS stands for Learning Management System. Learning Management Systems play a crucial role in organising, delivering, and tracking educational and training initiatives in a centralised and efficient manner.

1.6 Enrollment Fee means the fee payable by you when you apply to become a student/candidate to obtain any qualification accredited/provided by GWG.

1.7 Malpractice Policy means the latest policy relating to malpractice, from time to time amended by an ACP or any applicable regulatory body.

1.8 Course Fee means the fee payable by you when you registerfor a specific course/exam. Verbal Abuse in an educational context might include the use of derogatory language, humiliation, orthe sharing orintention of sharing private information is unethical.

2.0 SCOPE OF TERMS AND CONDITIONS

2.1 These conditions govern yourrelationship with GWG and come into effectthrough any registration or enrolment you undertake with GWG.

2.2 In accordance with the preceding clause, these Conditions outline the fundamental obligations of GWG, as well as yourresponsibilities, which encompass fees and payments, among other things.

2.3 However, more comprehensive information regarding your obligations, your ACP, the GWG relationship, and your conduct will be detailed in the relevant policies.

3.0 ENROLMENT, TRANSFER AND CANCELLATION

3.1 Your enrollment with GWG becomes effective only upon GWG issuing you an official enrollmentreceipt andupon GWG receiving the enrollmentfees, and,if applicable, any other specified fees in full.

3.2 By enrolling in a qualification, you agree to adhere to the regulations outlined in the qualification rules and regulations policy or guidelines established by GWG/ACP.

3.3 Enrollment will be confirmed only when the transferis completed to GWG by the ACP, after payment of any applicable transferfees.

3.4 GWG will not be held responsible for any outstanding fees orfines related to the previous institute or ACP, andthe student musttake responsibility for settling them. This ensures that all learners meet the required standards and are fully prepared for the examination

3.5 Learners who have not completed their designated batches and Formative Assessments (Minimum 80%) are not eligible to be registered for examinations under any circumstances. Learners can confirm theirintentto registerforthe exam while the batches are ongoing,but the exam must be taken only afterthe completion of all batches. The incomplete Formative Assessment details of Learners found during the closing Interview will be reported to NEBOSH.

3.6 It is the responsibility of studentto verify thatthe entries made in the enrollmentform is accurate and inaccuracies made by you in the enrollmentform are notthe responsibility of Green World Group. A photo ID p r o o fmust be submittedalong with the enrollmentform at the time ofenrollment with GWG.

3.7 Cancellation ofregistration for any course can only be done before officialregistration with the ACP, before the start ofthe class, or before receiving any study materials.Ifthese criteria are met, a 100% refund ofthe amount paidwill be issued. Any applicable VAT or other taxes will be refunded only after approval by the regulatory/competent body of the respective country and refunded back to GWG.

3.8 Learners are eligible for a 100% refund if the request is made within 24 hours of registration, provided they have not accessed the course materials by logging-in, downloaded the materials,watchedany e-learning videos orjoined any batch. Ifthe learner accessed the course materials mentioned orjoined batch below, deductions would be applicable.

Partial Refund: Learners may receive a 50% refund based on applicable deductions mentioned below. The request has to be made within 10 days from the registration date, regardless ofwhether course materials by logging-in, downloading the materials, or watching any e-learning videos have been accessed, but before completing 10 days.

No Refund: 10 days afterthe registration date, no refund will be provided, even ifthe course materials have not been accessed or batches have not been attended.

Under circumstances not explicitly mentioned below or upon a thorough review of the student enrollment process, if GWG competent authorities find the learner eligible for a refund, the following charges may be deducted from the amount paid:

  • LMS access charge (ifissued to the learner)
  • Course material charges
  • ID issued to the candidate
  • Any applicable taxes paid to the relevant government authorities by GWG
  • Any admin charges
  • Any scholarship amount granted by GWG or any other external parties
  • Charges levied by any bank thatthe learner has chosen to make the payment
  • Exchange rates that have been incurred during the payment
  • Any fees/service charges paid to any accreditation bodies/exam bodies
  • Any charges applicable forthe classes thatthe learner may have attended
  • Any othermiscellaneous/service charges that mayhavebeen identified during the contract
    termination.

Refunds for payments made through external payment channels (Tabby/bank EMI options) are subjectto theirrespective refund policies. Such refunds will only be issuedafter obtaining approvalfrom the corresponding bank/external channels.

Under no circumstances will a refund be paid/transferred to any third party otherthan the registered learner.

All refunds will be processed through banks andtheirrespective channels, ifany.

3.9 For any cancellations afterregistration with the ACP,the start ofthe class, orthe receipt of study materials, the following fees and charges will be deducted: registration fees, administration fees, course material fees, tutor charges, LMS subscription charges, VAT, other taxes, and any other applicable charges.

The Accounts/Finance Department will provide detailed explanations of any additional charges, and their decisions on such matters will be considered final and not subject to further questioning.

Transfer of fees from one course to another orto a different date will be considered on a case-by-case basis, dependent on the date and seat availability in the course.

Registration fees with the accreditation body are not transferable to alternative examinations, alternative courses, later examination sittings, or between candidates unless and until approved by the ACP.

3.10 Any applicable registration fees/training fees/ taxes as applicable (if any) forthe new dates/course must be paid by you.

3.11 GWG reserves the rightto cancel a course due to unavoidable situations or unforeseen circumstances; however, GWG will reschedule the course and inform all students well in advance, as far as reasonably practicable. During this process, no refunds are eligible under any circumstances.

4.0 MANDATORY COMMITMENT TO NEBOSH QUALIFICATIONS

4.1 To be eligible for examination registration with NEBOSH, it is mandatory for you to successfully complete the prescribed number of taught hours and various formative assessments, as communicated or provided on the E- Learning site, NEBOSH, or GWG guidance documents.

4.2 The requirement to fulfil the mandatory taught hours and formative assessments is a strict policy, and no exceptions will be made under any circumstances. As a student, you are solely responsible for ensuring compliance with the taught hours and formative assessment requirements on an ongoing basis.

4.3 GWG reserves the rightto verify attendance and completion oftaught hours, as well as the fulfilment of formative assessments, through appropriate means, including but not limited to attendance records, assessmentrecords, or any otherreasonable method deemed necessary.

4.4 GWG reserves the right to share your course progress, including attendance records, assessmentresults, and any otherrelevantinformation,with NEBOSH or any otherregulatory body as required for compliance, accreditation, disputeresolution, orcertification purposes.

4.5 Failure to complete the mandatory taught hours and formative assessments within the specified timeframewillrender you ineligible forany refunds or compensation. GWG shall not be held liable for any costs or expenses incurred by the participant as a result oftheirinability to meet the required taught hours and formative assessment requirements.

4.6 GWG reserves the right to amend or modify the terms and conditions, including the mandatory taught hours and formative assessment requirements, based on any future specification changes in the syllabus at any time without prior notice. However, if the updated change is applicable to your course curriculum, you will be notified, and itis your responsibility to complete it withoutfail.

4.7 If any provision ofthese terms and conditions is deemed invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

5.0 PAYMENT OF FEES

5.1 You are obligated to settle all fees associated with a course prior to the exam date without exception. GWGreserves the rightto deny your attendance atthe exam/classes/completion certificates if any fees remain outstanding.
5.2 Thirty percent(30%) ofthe totalfees must be paid atthe time ofenrollment with GWG; otherwise, enrollment will not be processed, and you will not be permitted to participate in the training.

Additionally, eighty percent(80%) ofthe totalfees must be paid atthe time of registration with the relevant Accreditation body; otherwise, yourregistration with the Accreditation body will not be processed. Any delays in exam registration orthe issuance ofthe final certificate by the Accreditation bodywill not be the responsibility of GWG. GWG reserves the right to adjustthe payment schedule based on the location/course type and course schedule.

5.3 Any taxes applicable to refunds will only be reimbursed to you upon confirmation/refund by the relevanttax authorities ofthe country where you made the payment with GWG. The total duration ofthis process is expected to be 6-8 months. An extension to this duration is possible, and in such cases, this information will be communicated to you as applicable.

5.4 One hundred per cent (100%) of the payment, including applicable taxes, is to be completed as per the payment schedule provided by the finance department without exception.

5.5 Payment Commitment C Course Attendance: Enrollment is confirmed only upon receipt of the initial payment. Full course fees must be paid according to the agreed instalment schedule or by the specified due date.

5.6 Students who attend more than seven (07) sessions without settling the full course fee will be deemed to have utilised the training services. Failure to complete the payment within the given timeframe willresult in automatic suspension from the course.

5.7 Dropout C Non-Payment Policy: Ifa student discontinues the course after sessions have commenced and has not completed the full payment, the initial payment will be nonrefundable.

5.8 However, the amount paid may be transferred once to another course of equal value within 60 days, subjectto course availability and prior approval from management. If a student attends more than seven (07) sessions and subsequently drops out without completing the payment, the amount paid will be forfeited, and no transfer or adjustment will be allowed.

5.9 Attendance Without Payment: Attending classes without completing the due payments is strictly prohibited. The company reserves the rightto withhold access to further sessions, study materials, certificates, and examination rights until all dues are cleared in full.

5.10 The student acknowledges and agrees to abide by the above terms and conditions.The management reserves the right to initiate legal or recovery action in the event of non – payment or breach ofthese terms.

6.0 REFUNDS UNDER MALPRACTICE POLICY

GWG has strict policies in place to prevent and address academicmalpractice and also has a NO-refund policy under any circumstances. GWG is committed to fair assessment, supporting access andequality ofopportunity for alllearners while safeguarding the integrity ofhealth and Safety qualifications.GWG therefore takes allegations ofmalpractice on the part oflearners seriously and reports to Accreditation Bodies.

6.1 GWG has strict policies in place to prevent and address academic malpractice, and also has a no-refund policy under any certain circumstances ofmalpractice.

6.2 ACP defines academic malpractice to include actions such as plagiarism, cheating, fabrication, collusion, and otherforms of dishonesty, which include third-party payment on behalf of learner other than blood relation for the course registration.

6.3 Penalties for malpractice may range from receiving a failing grade on the assignment upto a permanent ban on appearing exams which will be decided by the accreditation bodies.

6.4 GWG have a clear no-refund policy once malpractice is detected by an accredited or competent body under any circumstances. This policy is communicated to students during the enrollment process/ during trainingandis also available throughouttheirlearning journey in the LMS portal which he/she provided with access. Reasons for a no-refund policy may include the costs associated with providing educational services, the commitment of resources based on enrollment, tutoring cost, taxes etc.

6.5 Any instance ofacademic malpractice will be reported to relevant accreditation bodies and regulatory agencies by ACP and GWG.

6.6 Alongside academic penalties for malpractice, there can be long-term consequences for learners found guilty ofacademic misconduct which is decided by the Accreditation bodies/ regulatory boards.

6.7 Learners are required to fully disclose any past or ongoing malpractice investigations at the time of enrolment. If a learner hides or fails to disclose such information and it is later identified by the ACP/GWG during exam registration or any stage of the process, the learner will not be eligible for a refund unless the Accreditation Body agrees to refund the exam registration fees. In accordance with Section 3.8 above, all applicable deductions, including administrative and course-related charges, will be applied before determining the
final refundable amount to the learner.

7.0 GREEN WORLD GROUP LIABILITY

GWG expressly excludes liability for:

7.1 Any loss or damage to your property unless caused by the negligence of GWG or it employees.

7.2 Any loss ofprofit, earnings, opportunities, orliving expenses, as well as any indirectloss suffered by you due to any act of omission or negligence by GWG, its employees, or agents, will not be the responsibility of GWG.

7.3 Nothing in these conditions shall operate to exclude forfraud orfor death or personal injury due to its negligence.

7.4 Neither you nor GWG shall have any liability to each otherfor any failure or delay in the performance of obligations

7.5 GWG has no liability to you should its website be unavailable to access at any time orfails to perform within usual parameters or at all. GWG does not guarantee thatits website is free from viruses and will be uninterrupted or error- free.

7.6 GWG will not be held liable for any fraudulent agency partnerships entered into by the learner. It is the learner’s responsibility to verify the authenticity of the individuals they engage with. Always refer to the GWG website for accurate information.

8.0 TERMINATION

GWG may terminate your enrolment orregistration at any time through written notice if:

8.1 You breach these Conditions, or any terms and conditions contained in any letter confirming your enrolment or any documents orpolicies issued by GWG/Accreditation bodies at any time.

8.2 You failto pay any fees due to GWG/Accreditation bodies.

8.3 It is discovered that you have provided GWG, through agents or otherwise, with any false or misleading information.

8.4 You do not meet allthe administrative or academic requirements specified in the guides issued by GWG/Accreditation bodies.

8.5 You are involved in any malpractice pursuantto the Malpractice Policy.

9.0 VERBAL OR PHYSICAL ABUSE

9.1 GWG will nottolerate verbal or physical abuse ofits employees, otherlearners or agents. Verbal abuse through educational online platforms, especially when itinvolves the disclosure of personal details of a learner or intention to share, is a serious concern.

9.2 This type of behaviour is not only unethical but can also have significant negative consequences for the individualtargeted. Any incident of such abuse may resultin:
a) Restriction of communication with you to specifiedmeans, e.g., via letteror email only, or
b) In cases where GWG, at its sole discretion, considers the abuse to be serious or in repeated instances of physical or verbal abuse, termination of enrolment with no refund and/orregistration with GWG, and/or exclusion from future enrolment orregistration with GWG.
c) In the eventthatthe same incidentis reported to the ACP(appropriate regulatory body or enforcement agencies), please be advised that your details will be shared with the legal authorities if a legal case is filed by the affected learner.

9.3 The unauthorized replication of content or videos from the GWG website, e-learning portal, or any social media platforms, including the duplication of company logos andthe use of company names by fellow learners on social media, is strictly prohibited.

9.4 Any such action willresultin appropriate measures being taken based on the jurisdiction where the learners are registered.

It is emphasized that learners engaging in such activities may be held responsible for any losses incurred by the company as a consequence. Detailed information pertaining to these violations will be conveyed to competent bodies and accreditation bodies.

10.0 DATA PROTECTION

GWG will hold personal information about you and will use the information as follows:

• To process your applications to GWG and administer your enrolment and registration for relevant Accreditation Body Assessments.
• To respond to requests from employers, recruitment agencies, other Higher Education Institutions, and similar bodies to verify the information provided by you. This may include providing verification of GWG qualifications (Accredited by Accreditation Body) in connection with applications for employment.
• To respond to queries raised by you orthe Accreditation Body.
• To address any disciplinary matters in respect to you.
• To respond to data requests from regulatory bodies.
• To recover any monies owed by you to GWG.
• To administer GWG’s policies
• To notify you of your course results
• To conductresearch aimed at enhancing and planning GWG’s accredited qualifications, teaching methodologies, and customer service, among other aspects.
• As a student memberin any WhatsApp group,itis strictly prohibited to disclose the contact details offellowlearners to external agencies, contactthem directly, utilize theirinformation for personal purposes, share any data between members, orreproduce such information in physical or hard copy formats.
• Any such actions are strictly prohibited unless explicit written authorization is granted by the CEO of the organization. Any such instance if found will be reported for appropriate actions to the relevant ACP/ regulatory bodies enforcement agencies of the respective country where he/she enrolled.
• All study materials (hard/copy copy) are the sole property ofGWG andshould not be shared with any other learners under any circumstances through any medium, unless and until approved by the Academic Director ofGWG, notless than a designation manager category.
• Any financial losses incurred due to this will be calculated by the competent authority, and you will be held responsible for com

11.0 ADDITIONAL TERMS FOR LEARNERS ENROLLING FROM INDIA

11.1 Compliance With Indian Consumer Protection Laws Learners enrolling from India will be protected in line with the Consumer Protection Act, 2019 (India). GWG shall ensure fair trade practices, non-misleading representations, and reasonable handling of genuine consumer grievances raised by India-based learners.

11.2 Pre-Contract Information and Transparency Before confirming enrollment, India-based learners will be providedwith clear and accurate information on:total course fees, applicable taxes (including GST,where applicable), refund rules, course duration, key requirements (such as mandatory attendance/taught hours), and accreditation status ofthe qualification. It is the sole responsibility of the learner to make sure that prior to registration, all the relevantinformation is aware andaccepted. Under no circumstances, halfthe way of course enrolment withdrawal of the course with a refund won’t be applicable as mentioned in section 3.8 above and Consumer Protection Act, 2019

11.3 Cooling-Off / Withdrawal for India Enrolments Where a learner enrolling from India hasnotaccessedany LMS content, downloaded course materials, attended classes, orjoined any batch, they may request cancellation within 24 hours ofenrollmentfora fullrefund ofthe course fee, withoutpenalty.This is in addition to and read together with the refund terms stated in section 3.7 and 3.8.

11.4 E-Commerce and Digital Services Compliance For India-based learners, GWG will comply with the Consumer Protection (E-Commerce) Rules, 2020, to the extent applicable to cross-border digital services, including transparency of service provideridentity, total price disclosures, andavoidance ofunfair or manipulative practices in advertising or marketing of courses.

11.5 Grievance Redressal for Learners enrolling from India Region A dedicated Learner Escalation Matrix is available to India-enrolled learners. Grievances will be acknowledgedwithin 48 hours (working days) and GWGwillaim to providea resolution or clearresponse within 30 days, subjectto reasonable investigation timeand cooperation from the learner.

11.6 Data Protection and Privacy for Indian Learners Personal data of India-based learners will be processed in accordance with GWG policies and, to the extent applicable,the principles ofthe Digital PersonalData Protection Act, 2023 (India), including lawful purpose, reasonable usage, and protection against unauthorized
disclosure, in addition to any data protection standards applicable in GWG’s operating jurisdictions.

11.7 Payment, Refund and Chargeback Handling (India) Paymenttransactions from India (including card, UPI, internet banking or EMI) will be handled in line with relevant Reserve Bank of India (RBI) regulations applicable to the respective payment instrument. GWG will initiate the refund within a reasonable period not exceeding 45 working days, excluding additionaltime taken by banks or payment gateways. This clause is applicable to all nationalities who register or make their payments through the India region,regardless of their citizenship or place of residence based on the RBI Payment C Settlement Systems Act, 2007

11.8 Unfair Terms and Interpretation for India-Based Learners If any clause of this Agreementis interpreted by a competent consumerforum in India as being excessively one-sided or unfairin the context ofIndian consumerlaws, such clause will be applied in a manner consistent with Indian consumer protection principles forIndia-based learners, without affecting the validity ofthe remaining terms.
